The Missing Will and Rectification of a Will - Webinar
Missing Wills are a problem for our profession.
A number of Professional Indemnity Claims are made each year in respect of the loss of a client’s Will by a Solicitor.
This Webinar will consider:
the current procedure for proving the tenor of a missing Will
what evidence the Court will require and the possible consequences of losing a client’s Will.
Further, Section 3 of the Succession (Scotland) Act 2016 came into force on 1 November 2016. This allows (arguably for the first time ever) a defectively expressed Will of a deceased individual to be rectified by the Court after his or her death.
This Webinar will also consider:
the provisions of Section 3 of the 2016 Act
what can, and cannot, be rectified under Section 3 and what evidence might require to be submitted in support of an application under Section 3.
Section 3 opens new risks of practice for our profession. We require to get to grips with the same as soon as possible.
