As the Brexit transition period nears its end, this webinar will consider the impact of the UK’s withdrawal from the EU in the family law field.
It will discuss the implications for EU instruments which family lawyers currently make use of in cross-border cases – as well as the other international instruments, and pre-existing domestic legislation, which will increase in importance in the future.
In particular, it will consider:
the general impact of EU withdrawal on the application of EU instruments in Scotland, and the situation when the transition period ends
the specific effect on divorce (and nullity) actions, in terms of both (i) jurisdiction in cross-border cases; and (ii) recognition and enforcement of decrees
the specific effect on parental rights/responsibilities orders, in terms of both (i) jurisdiction in cross-border cases; and (ii) recognition and enforcement of judgments
the specific effect on the enforcement of maintenance awards
