Licensing continues to be one of the most dynamic areas of practice and our new conference will bring together some of the most important current developments while also taking a step back to place that progress in the context of recent practice.
Chaired by Stephen McGowan of TLT LLP, the conference, taking place online, will include topics ranging from licensing of outdoor spaces, licensing board 5 year policy trends and the taxi and the gambling white paper to licensing hours, an overview of recent licensing caselaw and taxi and private hire car licensing.
An expert panel of speakers will join Stephen, including Scott Blair of Terra Firma Chambers, Audrey Ferrie, Archie MacIver from Brunton Miller, Sandy Munro of Aberdeen City Council, Raymond Lynch from North Ayrshire Council and Paul Fair of Clackmannanshire Council.

In this session Archie will look at how policies have changed over the years and whether consultation does make a difference. Is your input effective? Is it worth taking the time to consult?

In his overview of recent licensing caselaw from around the UK, Scott will also provide analysis of the recent judicial reviews of sexual entertainment and short term let licensing in Edinburgh (Kaagabot Ltd and others v City of Edinburgh Council and Averbuch and others v City of Edinburgh Council).

Gambling White Paper - worth the wait?
The key proposals with particular reference to local authorities and Scotland will be discussed. The process for implementation and the Gambling Commission's plans for consultation over the coming months will also be considered.

This session will provide a discussion of the proposed revised Taxi and Private Hire Car Licensing Guidance and what it means for local authorities and the trade. There will also be an update on the new tax checks for licence renewal applications.

Licensing 101: Licensing Hours
In the next of his Licensing: 101 series, Stephen McGowan will be going back to basics on licensed hours under the Licensing (Scotland) Act 2005 - covering both off and on sales hours, the myth of 24 hour licensing, exceptions to the licensed hours, rules for residents, one off extensions and general extensions, and a sideways glance at the duty to trade in the context of the five year policy reviews.

Life as an LSO: challenges and trends
In this session, Paul will reflect on where LSOs started, what people thought they would be, and where they are now. Topical and current challenges including those faced through the COVID recovery period, interaction with premises managers and licence holders and the importance of good standards of staff training and record keeping will all be considered. Paul will also provide advice on contacting LSOs, the range of assistance they can offer and clarity about what they can’t do.
