Powers of Attorney – the difficulties - Webinar

The Adults with Incapacity (Scotland) Act 2000 is in many ways praiseworthy – the Scottish Government grasped a nettle which the Westminster Government had shied away from for many years. 

However, particularly with Powers of Attorney, various difficulties have now been identified:

• who can hold the Attorney to account whilst the granter of the Power of Attorney is still alive?
• who can hold a former Attorney to account after the death of the granter of the Power of Attorney?
• and does the Adults with Incapacity (Scotland) Act require to be amended – with particular reference to Sections 6 and 81?
