The Digital Markets, Competition and Consumers Act is a paradigmatic legislation aiming to establish a new pro-competition regime in digital markets
It is built on the premises and foundations of traditional competition law, but goes far beyond its established mandate, competences and goals. The UK regime is pioneering in many respects and it will be used by many jurisdictions in the future in their attempts to tailor competition in their digital markets. The new set of rules grant wide discretion to the CMA in designing the key parameters of the game – but in contrast to the legislative proposal the final version of the Act has been significantly modified.
