Regulatory offending – practical considerations in and around prosecution of regulatory offences
Many licensing regimes are underpinned by the prospect of breaches being prosecuted in the criminal courts, but what does it take to get prosecution raised for a breach? What will the Procurator Fiscal be looking for? And conversely, if you/your client are on the receiving end of an investigation, how do you prepare/respond to it?
Sally Clark, CMS
Gambling Act update
This presentation will cover the latest topics in gambling. It will look at the recent trends in gambling. There will be an update on the possible changes to bingo and the introduction of GIAs. As always there will be a look back at certain GC regulatory sanctions, to show the types of enforcement action the Gambling Commission are currently focusing on.
Chris Rees-Gay, Woods Whur
Short term let licensing – renewals, emerging themes and review of developments thus far
As a solicitor for The Highland Council and an active member of both the SOLAR working group on short term let (STL) licensing and the Scottish Government’s Guidance Review Group, Gary Somers has been focusing on STL licensing since its introduction in October 2022. Given that the majority of licensing authorities in Scotland typically granted initial STL licences for a period of three years, most licence holders and their agents will now be considering or dealing with the renewal of their current licence. Gary will use this as a good opportunity to discuss the process for renewing a licence and to review some of the developments and emerging themes from STL licensing over the last three and a half years.
Gary Somers, Highland Council
